A Review of Mandani v Rabinowitz
CLSA
Webinar

Presented by Landon Blake, Redefined Horizons

The California Court of Appeals recently decided a case related to a fence encroachment in Los Angeles. In its decision, the court restores a bit of the sanctity of boundary locations per paper title rather than physical occupation. It also makes it easier for land owners harmed by a physical encroachment to require the removal of that encroachment by the neighbor. In this webinar, Landon reviews the facts of the case and the legal issues it discusses. In the webinar, Landon answers the following questions:

1. What is the difference between a permanent encroachment and a continuing encroachment? Why is understanding the difference important for boundary surveyors?
2. How is the statute of limitations on a nuisance claim impacted by a continuing encroachment?
3. What test can be used to determine if an encroachment is permanent or continuous?
4. What factors need to be considered when calculating the damages of a continuing encroachment?
5. What change in California real estate is the appeals court recognizing in this court decision?
